This Volunteer Acknowledgment and Release sets forth the responsibilities and expectations for your volunteer service and releases Band Together from any liability regarding your experience.
Nature of the Volunteer Role I, the undersigned volunteer (“Volunteer”), wish to perform services for Band Together NC, Inc., its directors, officers, employees, agents, sponsors, partners, successors, and assigns (collectively, “Band Together”). The term “Activities” means all volunteer work, travel, meetings, rehearsals, load-in/load-out, concerts, festivals, and any other event or function in which I participate on Band Together’s behalf, whether on or off Band Together premises and whether before, during, or after the scheduled event date. “Activities” might include cleaning; serving/restocking food; helping guests; using technology and helping guests do so; moving barricades; tables, chairs, small tents, signage, etc; shucking oysters; restocking bathrooms; removing trash; executing sales of merchandise; applying labels or stickers; distributing supplies; hanging/removing lights; decorating/removing decorations; loading/unloading trucks; wear Band Together signage; and other duties as assigned. I understand that my role is to assist in the execution of Band Together events and/or fundraising activities, helping to ensure smooth operations and a positive experience for attendees. This is a hands-on role that requires a strong commitment to customer service, teamwork, and Band Together’s mission.
Nature of Volunteer Relationship I understand that my relationship with Band Together is limited to a completely voluntary position and this Acknowledgment and Release does not create an employee, contractor, or agent relationship between myself and Band Together. I understand that I am voluntarily providing services to Band Together and will receive no wages, benefits, or other compensation for my volunteer services.
Code of Conduct I understand as a volunteer of Band Together, I must always conduct myself in a manner that does not jeopardize Band Together’s name, image, or reputation. Band Together volunteers must operate in the best interest of Band Together, maintain the highest standards of conduct and ethical behavior, and work collaboratively and respectfully with Band Together staff, participants, and volunteers at all times. I also understand that I must follow written safety protocols at events for both my safety and that of event attendees.
I agree NOT to: (1) authorize the use of the name, emblem, endorsement, services, or property of Band Together without prior written consent to do so; (2) take any action that would confer a financial benefit or accept any non-trivial gifts or favors that would confer a benefit to me or an entity which I am affiliated; or (3) publicly utilize any Band Together affiliation in connection with the promotion of partisan politics, religious matters, or positions on any issue not in conformity with Band Together’s mission.
Harassment and Discrimination Band Together is committed to fostering an inclusive, diverse, and equitable environment where all individuals are respected and valued. We do not discriminate, nor do we tolerate discrimination or harassment on the basis of race, color, religion, gender, gender identity, sexual orientation, age, national origin, disability, or any other characteristic protected by law. Through the power of live music and our community-focused initiatives, we embrace diversity in all its forms, ensuring that everyone, regardless of background, has the opportunity to connect, engage, and be a part of the positive change we are creating in our community.
Weapons Prohibition
Weapons are strictly prohibited at all Band Together events. I agree not to bring a weapon of any kind to the event, including all pre-event and post-event activities.
Consent to Emergency Treatment I hereby consent to emergency treatment, and authorize Band Together to obtain such emergency medical treatment for me, in the event of injury or illness, or otherwise if in Band Together's opinion such treatment becomes necessary, while participating in Band Together events, including but not limited to first aid, doctor's care, hospitalization, transportation to medical facility, and/or any other relevant care.
Photo and Video Consent I, for myself or as the parent or legal guardian of the below-named minor child or other individual unable to give consent, irrevocably grant to Band Together all right, title, and permission to create, use, edit/alter, copy, publish and display material containing my name, image, voice, words or likeness (“Material”) for any lawful purpose, and in any and all media including digital/internet/print use, without payment or any other consideration or credit to me.
I understand that these Materials may be used in various applications that include but are not limited to: print media (newspaper, magazine, brochures), electronic media (video, audio) and online platforms (social media, email, website). Any of these Materials may be used in both edited and raw formats in their entirety or in part.
Further, I hereby agree to assign, transfer and convey to Band Together a perpetual, irrevocable, transferable, and royalty free license to use and make derivative use of any and all photographs, motion pictures, recordings, or other records of Band Together events I may take or capture to Band Together for its charitable purposes. I also grant permission for Band Together to publish and recognize my participation on its website.
Volunteer Duties I understand I will only accept positions I am physically and mentally capable of performing. I agree it is my sole responsibility to obtain the necessary mode of transportation.
If I am unable to perform as agreed, I will advise the point of contact immediately.
In the event I witness any activity that will impede safety, I will immediately notify staff to help reduce the likelihood of harm. If I witness any actual or potential illegal, unlawful, unethical conduct or a violation of a Band Together policy, I will promptly report such incidents to Band Together staff immediately for review.
I understand and agree that Band Together reserves the right to refuse or dismiss anyone that may cause a disturbance or hindrance that could jeopardize the safety of others.
Volunteers Under 18 I understand that a parent or legal guardian must sign this Acknowledgment and Release for any volunteer under the age of 18. Minors must be accompanied by a responsible adult during the event. I acknowledge Band Together will not supervise or be responsible for minor volunteers.
Contagious or Infectious Disease Acknowledgement I hereby acknowledge and understand my participation includes the possible exposure to an illness from contagious or infectious diseases. I accept the risk of life-threatening illness, temporary or permanent disability, or even death. I understand Band Together cannot guarantee I will not become infected with a contagious or infectious disease, and volunteering at an event may increase my risk of contracting such disease or illness.
Further, I knowingly and voluntarily agree to follow all required and relevant federal, state, local, and Band Together guidelines and recommendations to maintain the health and safety of event/program attendees. I will not participate in an event/program if I am sick or if I have knowingly been exposed to someone with symptoms of an infectious or contagious disease.
Termination I understand that either I or Band Together may terminate this volunteer relationship at any time, with or without cause.
Jurisdiction This Agreement and any claims shall be governed by the laws of, and brought within, the State of North Carolina.
Severability I agree that if any portion of this Acknowledgment and Release is deemed to be invalid, the remainder of the Acknowledgment and Release will still be binding and enforceable.
Assumption of Risk; Waiver and Release of Liability
I acknowledge that there are risks volunteering in Band Together Activities. I understand that the Activities may involve loud music, heavy equipment, electricity, vehicular traffic, crowds, alcohol service, adverse weather, trips, slips, falls, physical exertion, exposure to illness (including COVID-19 or similar communicable diseases), and other hazards that can cause serious injury, illness, property damage, or death. On behalf of myself, and any minor child(ren) of mine who are present, I KNOWINGLY AND VOLUNTARILY ACCEPT AND ASSUME ALL SUCH RISKS, WHETHER OR NOT SPECIFICALLY DESCRIBED ABOVE, THAT I MAY ENCOUNTER IN CONNECTION WITH THE ACTIVITIES OR FROM ATTENDANCE AT THE EVENT.
To the fullest extent permitted by North Carolina law, I hereby fully and completely waive, release, discharge, and hold harmless Band Together, its directors, officers, administrators, representatives and executors, past and present employees, volunteers, agents, supervisors, participants, all state and local governments, assigns, sponsors, their representatives and successors and other persons (collectively, the “Releasees”), from any and all claims, liabilities, damages, demands, actions, causes of action, losses, costs or expenses of any kind (collectively, “Claims”), including those based on the negligence of Band Together, that arise out of or relate in any way to the Activities or my presence on property used for the Activities. This release does not apply to Claims resulting solely from Band Together’s gross negligence or willful misconduct, to the extent such exclusion or limitation is void under North Carolina law.
Indemnification
I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS Band Together from and against any and all Claims arising out of (a) my own acts, omissions, or breach of this Agreement, or (b) any injury or damage that I may cause to third persons or their property during the Activities.
